1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account or submit content. By using the Services, you represent that you meet this requirement and that the information you provide is accurate.

2. The Services

DiningReviews.net is a curated directory of restaurants featuring reviews from social-media food influencers, along with diner reviews and related features. Listings are selected editorially. Some listings or placements may be paid; where a listing is paid, we aim to distinguish it from editorially curated content. We do not guarantee that any restaurant, influencer, rating, or review is accurate, current, or complete.

3. Accounts

Some features require an account, which we provide through a third-party authentication provider (Clerk), including sign-in with Google. You are responsible for your account and for all activity under it, and you agree to provide accurate information. Notify us promptly of any unauthorized use.

4. Your content

“Your Content” means reviews, ratings, and other material you submit. Your Content must be plain text only. You retain ownership of Your Content, and you grant DiningReviews.net a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, and distribute Your Content in connection with operating and promoting the Services.

You represent that Your Content:

• reflects your genuine experience and opinion;
• does not infringe any third party’s intellectual property, privacy, or other rights;
• is not false, defamatory, harassing, hateful, obscene, or otherwise unlawful; and
• does not contain spam, advertising, malware, or others’ personal information.

We may review, moderate, refuse to publish, or remove Your Content at our discretion, and we are under no obligation to display it. Reviews are held for moderation and, once approved, are shown publicly.

5. Influencer and restaurant listings

Influencer and restaurant profiles are compiled from publicly available information and embed publicly posted social-media content using each platform’s official embed. We are not affiliated with, and do not endorse or claim endorsement by, any influencer or restaurant unless expressly stated. If you are an influencer or restaurant and would like a correction or removal, contact us at [email protected].

6. Acceptable use

You agree not to:

• use the Services for any unlawful purpose or in violation of these Terms;
• submit fake, incentivized, or misleading reviews;
• scrape, harvest, or bulk-download content except as expressly permitted;
• interfere with, disrupt, or attempt to gain unauthorized access to the Services; or
• impersonate any person or misrepresent your affiliation.

7. Intellectual property

The Services, including their design, text, and original content, are owned by DiningReviews.net and protected by intellectual-property laws. Third-party names, logos, and content remain the property of their respective owners. Except for Your Content and third-party content, you may not copy, modify, or create derivative works from the Services without our permission.

8. Third-party services and links

The Services rely on and link to third parties (including Clerk, Cloudflare, TikTok, YouTube, and restaurant or influencer websites). We are not responsible for third-party services or content, and your use of them is governed by their terms and policies.

9. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT LISTINGS, RATINGS, OR REVIEWS ARE ACCURATE, COMPLETE, OR CURRENT, OR THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DININGREVIEWS.NET WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES.

11. Indemnification

You agree to indemnify and hold harmless DiningReviews.net from any claims, damages, or expenses arising out of Your Content, your use of the Services, or your violation of these Terms.

12. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including violation of these Terms. You may stop using the Services at any time.

13. Governing law

These Terms are governed by the laws of the State of Arizona, United States, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts located there for any dispute not subject to another binding agreement.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Services after changes take effect constitutes acceptance.
